| Rental.
1. Packaging supplied with the equipment shall be held
by the Hirer during the period of rental and shall be
used to re-pack the equipment on its return to its owner.
2. You must pay for the whole of the agreed rental period
even if you return the equipment early.
3. We do not automatically collect. It is your responsibility
to inform us at least 3 working days before the start
of the next invoicing period that you no longer require
our equipment and to obtain an Off Hire Number. You
will be charged in full for the next invoicing period
if collection has not been requested in time.
4. Our carriers will NOT collect equipment unpacked
. Abortive collection calls will be chargeable and may
result in an extension to the original invoicing period.
5. You will be notified of any items not returned off
rental including cables, manuals and any other accessories.
You will be invoiced, at replacement cost, for items
not returned within 7 days of notification.
6. You are responsible for lLOSS, THEFT or DAMAGE and
therefore you must insure our equipment for the manufacturer’s
current list price. You will pay all costs incurred
in rectifying the condition of any equipment returned
damaged or unclean. We do not accept liability for consequential
loss unless subject to law court ruling under English
Law.
7. You must request our permission if you wish to move
our equipment from the original delivery site. We will
supply you with separate terms and conditions for equipment
you wish to take outside the UK.
8. Our equipment should be accessible at all times to
us, or our appointed agents for repair, maintenance
or recovery.
9. Our rental charges do not include delivery and collection.
These will be charged separately.
10. Rental charges include maintenance within the UK.
Full details of our maintenance support levels are available
upon request . Additional maintenance options are also
available..
11. The equipment is supplied with an operating system.
In certain circumstances licensed documentation has
to be completed and signed prior to delivery. Full details
of our Customer Owned Software Policy & Customer
Agreement is available on request.
12. If you cancel after having placed your order, we
reserve the right to charge up to the full value of
the order, administration and handling costs.
13. If you default in any of your obligations (including
payment of the invoices within the credit terms stated
above) or in the event of your insolvency or liquidation
or the appointment of a receiver of your business or
petition being presented for the appointment of an administrator
of you we shall be entitled at our discretion without
prejudice to any other remedy to terminate the contract
and to repossess the equipment.
14. The equipment shall at all times remain the property
of us and you shall not do or cause to be done anything
whereby our rights in respect of the equipment may be
prejudicially affected.
15. Lease IT Europe does not specifically warrant any
equipment's compatiablity or sutiability. It is the
responsibility of the customer to contact the manufacturer
directly for this information.
Except as expressly stated within the Lease IT Europe
"Conditions of Rental", all warranties &
conditions, whether expressed or implied by
statute, common law or otherwise (including, but not
limited to fitness for purpose) are hereby excluded
to the extent permitted by law.
Term of Reference: ‘System’ or ‘Systems’
shall mean Systems, Software and/or Hardware
In particular, but without limitation to the foregoing,
the Client acknowledges that where the System is used
in conjunction with, or is interfaced to,
other Systems (including Systems previously supplied
by Lease IT Europe) Lease IT Europe shall not be liable
for any loss occasioned by the
exchange of date data to or from such Systems which
has a date format which is not compatible with the date
format of those Systems.
As used above, the term ‘date format’ shall
mean the field configuration and / or the associated
processing which contains the date information
relating to the System or Systems.
